We value our relationships with royalty owners and want to make it easy and convenient for you to access the information and resources you need from us. The categories below give you access to critical forms and a set of frequently asked questions to help you communicate with us. Address Change Requirements

Please notify Highlander as soon as possible when your mailing address changes. For your protection, we will not accept address changes by telephone. Please submit your change by completing the Change of Address form located below in the Links/Form section. 

Lost or Stolen Checks

If you receive payment by a paper check and you haven't received your check within 15 days of the normal payment date, please contact our Owner Relations department to reissue the check.  Remember, if you ask for a replacement check, the original check will be immediately voided. This means that if your original check arrives on the next day, it will not be honored by our bank. For your convenience, we recommend you sign up for Direct Deposit by completing our ACH Request form located below in the Links/Forms section to eliminate the risk of lost, stolen or misplaced checks. With this option, your funds are available to you on a more timely basis and you'll eliminate the risk of your paper check being lost in the mail.

Name Changes

For individual name changes due to marriage, divorce, etc., please furnish Highlander with a copy of the marriage certificate, divorce decree, or other document effecting the name change. For a company or corporation name change, please provide Highlander with a copy of the Certificate of Name Change or Certificate of Merger. 

Sale of Your Interest

For a full or partial conveyance of a mineral, royalty, overriding royalty or working interest, please furnish us with a copy of the conveyance document recorded in the county and state where the property is located. 

Trusts

When you create a trust, please provide Highlander with copies of the Trust Agreement and the recorded conveyance into the Trust. When you dissolve a trust, please provide us with a copy of the Dissolution of Trust or other appropriate recorded conveyance. 


Change of Ownership Due to Divorce

Please provide us with a copy of the Final Divorce Decree and copies of all recorded conveyances pertaining to the matter.

Deceased Owner

Title to real property owned by the deceased party passes either by testate succession (with a probated Last Will and Testament) or by intestate succession (without a Will). In the absence of a Will, or if the Will has not been probated, title to real property passes according to the Laws of Descent and Distribution for the State in which the wells are located, and not the state of residence. 


Depending on the circumstances, please provide the following documentation in the event of a deceased owner:

 

Testate (probated Will) 

  • Copy of PROBATED Last Will and Testament, with Certificate of Filing containing Probate File number from Probate Court 
  • Death Certificate 
  • Letters Testamentary naming the Executor 
  • Determination of Heirship, Judgment of Possession or other probate documents, if appropriate 
  • Final Decree of Distribution, if appropriate 
  • Proof that debts and inheritance taxes have been paid 
  • Recorded deed, if appropriate, to beneficiaries 
  • Addresses and Social Security/Tax ID numbers for each party inheriting 
  • Record a certified copy of the Will & Probate in the County/Parish where the wells are located OR provide documentation of ancillary probate proceedings in the state where the wells are located


Intestate (without a Will/or when a Will is not probated) 

  • Death Certificate 
  • Affidavit of Heirship. Please note that we cannot accept Heirship Affidavits completed by direct family members (those with a beneficial interest) of the deceased owner. Affidavits must be recorded in the county/parish where the well/property is located. A blank Affidavit of Heirship form is located below in the Links/Forms section.

Other

Guardianships: When an owner is declared incompetent, please provide Highlander with Letters of Guardianship issued by the local court. 

Minors: When a minor reaches the legal age, please provide Highlander with a copy of the minor's Birth Certificate. 

Termination of Joint Tenancy Upon Death: Please provide Highlander with a copy of the Death Certificate and the social security number of the new owner.
Life Tenant (Life Estate): When an owner of a Life Estate dies, please provide Highlander with a copy of the Death Certificate and the names, addresses, and social security numbers of the persons who succeed to the interest (remaindermen). In some instances, we may need further information, including a copy of the documents that originally created the Life Tenancy and named the successors to this interest.
